Welcome to DawnValleyFarm ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at dawnvalleyfarm.sbs (the "Service") operated by DawnValleyFarm.
By booking a charter or accessing our Service, you agree to these Terms. If you do not agree with any part of the terms, then you are not permitted to use the Service.
2. Service Overview
DawnValleyFarm offers luxury yacht charter services, which include but are not exclusive to:
- Day-long yacht rentals
- Evening sea voyages
- Business-oriented retreats
- Exclusive events
- Extended charters
Our services depend on vessel availability and meteorological conditions. We have the right to change or cancel services at our discretion.
3. Booking and Reservations
3.1 Booking Process
When booking a charter, you must:
- Have reached 18 years of age or older
- Provide information that is truthful and complete
- Make a deposit payment as outlined in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A confirmed reservation is only achieved once payment has been made and our confirmation is communicated in writing. We hold the authority to decline service to any individual at our own bias.
3.3 Availability
Charter scheduling is based on the accessibility of vessels and favorable weather conditions. We will attempt to accommodate your requested dates and hours as feasibly as possible.
4. Payment Terms
4.1 Pricing
All listed rates are denominated in € and incorporate applicable taxes unless indicated otherwise. Price quotes are subject to modification without prior notice.
4.2 Payment Schedule
- Deposit: A sum equal to 50% of the full charter cost, payable at the time of reservation
- Balance: Payable 48 hours prior to the departure of the charter
- Incidental expenses (if any): Payable upon completion of the charter
4.3 Payment Methods
Accepted methods of payment include major credit cards, electronic bank transfers, and bank-certified cheques. Payment processing is completed using secure, encrypted procedures.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full refund minus any processing charges
- Between 24 to 72 hours before departure: Refund of 50%
- Less than 24 hours before departure: No refund will be issued
5.2 Weather Cancellations
In case the captain deems weather conditions as unsafe, we will provide an option to:
- Schedule the charter for a new date without incurring further costs
- Issue a full refund if rescheduling proves to be unfeasible
5.3 Mechanical Issues
If mechanical issues arise with your appointed vessel, we will strive to arrange an appropriate substitute. Should a replacement not be available, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Adhere to all directions provided by the crew
- Make use of the safety gear when necessary
- Disclose any medical conditions that may impact their safety
- Stay within the designated areas on the vessel
6.2 Prohibited Items
The following items are prohibited on board:
- Containers made of glass
- Illegal drugs
- Firearms or other weapons
- Pets (without prior consent)
6.3 Conduct
Patrons must behave in a respectful and considerate manner. We reserve the right to conclude a charter prematurely without refund if a guest's behavior constitutes a safety hazard or diminishes the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the charter fee paid by you. We are not accountable for:
- Injuries sustained due to personal negligence
- Theft or destruction of personal belongings
- Indirect, incidental, or punitive losses
- Delays caused by extreme weather or situations beyond our influence
7.2 Insurance Coverage
Comprehensive marine insurance is held by us, covering both our fleet and operations. Passengers must ensure their own personal and travel insurance coverage.
7.3 Assumption of Risk
By taking part in any of our charter offerings, you recognize that activities at sea come with inherent dangers and you accept responsibility for your personal safety and health.
8. Modifications and Itinerary Changes
We retain the right to alter itineraries, paths, or timetables due to weather, safety concerns, or operational needs. Every effort will be made to provide similar experiences of comparable value.
9. Force Majeure
We are not responsible for adjustments, delays, or cancellations caused by events outside our control, such as:
- Harsh weather conditions
- Acts of nature
- Government edicts
- Port closures
- Equipment malfunctions
10. Privacy and Data Protection
Your private data is managed in compliance with our Privacy Policy. By engaging our services, you grant permission for the collection and usage of your data as specified in the policy.
11. Intellectual Property
Our website's content, such as text, graphics, logos, and imagery, is safeguarded by copyright and trademark laws. Reproduction, distribution, or creation of derivative works without our explicit approval is not allowed.
12. Governing Law
The governing laws of France oversee these Terms. Any disputes will be adjudicated in the courts situated in Cannes, France.
13. Changes to Terms
We may revise these Terms as necessary. Any revisions will be announced on our website with a note of the date of amendment. Continued engagement with our services implies acceptance of the new terms.
